Model Mediation Clause of BIMC

适用于争议发生前 For future disputes:

凡因本合同或与本合同有关的任何争议，包括任何有关合同的成立、效力或终止问题，均应首先提交深圳市蓝海法律查明和商事调解中心按照该中心当时有效施行的调解规则进行调解，且该调解规则视为并入本条款。  

Any dispute arising out of or in connection with this contract, including any question regarding its existence, validity or termination, shall first be referred to Benchmark International Mediation Center (BCI&BIMC) for mediation under its then current Mediation Rules, which Rules are deemed to be incorporated by reference into this clause.

适用于争议发生后 For existing disputes:

凡因本合同或与本合同有关的任何争议，包括任何有关合同的成立、效力或终止问题，各方当事人一致同意提交深圳市蓝海法律查明和商事调解中心按照该中心当时有效施行的调解规则进行调解。接受法院或其他机构委托或委派行调解的，亦应遵守该机构有关诉调对接、仲裁-调解对接等的规定。

Any dispute having arisen out of or in connection with this contract, including any question regarding its existence, validity or termination, the parties hereby agree that the dispute shall be referred to Benchmark International Mediation Center (BCI&BIMC) for mediation under its then current Mediation Rules. Where mediation is conducted under the entrustment or appointment by a people’s court or other organization, it shall follow the regulations of coordination of mediation and litigation and those of coordination of arbitration and mediation.
